As long as your aren't throwing a CEL, you should be fine. I don't believe a cold-air intake system will have any negitive consequences as far as failing an emissions test. The only thing you may come across is your air/fuel ratio fluctuating and slight change in idle.
I have had my 2006 Scion tC since November 2007 and bought my AEM Cold-Air Intake System shortly afterwards, and have never failed any emissions test or had a CEL come on. You'll be just fine and pass with flying colors.
